01Included use
Your purchase includes broad ongoing rights to enjoy, share and use the final delivered song. You may use it for private listening, gifting, family sharing, weddings, birthdays, anniversaries, tributes, personal videos, events, personal social media, your own website, organic social media, and content that promotes you or your own business.
You may also use the song in your own monetised social or creator content. These included rights do not allow you to resell or sublicense the song, sell copies of it as a standalone product, distribute it as your own commercial music release, use it in paid advertising, or license it for third-party client work.
02Extended commercial use
An Extended Commercial Licence is only required for uses beyond the rights already included with your purchase. This includes paid advertising, third-party client work, broadcast or film/game synchronisation, resale or sublicensing, large-scale commercial campaigns, or releasing and distributing the song as a standalone commercial music product.
An Extended Commercial Licence gives permission from Unsaid Melody for the specific permitted use, but does not guarantee copyright registration, platform approval, monetisation approval, advertising approval or freedom from all third-party claims.
03Rights in the delivered song
After full payment and delivery, you receive a non-exclusive, perpetual, worldwide licence to use the final delivered song under the included rights described in these Terms. If you purchase an Extended Commercial Licence, those additional rights also apply.
Unless separately agreed in writing, you receive usage rights rather than a formal copyright assignment. Unsaid Melody retains rights not expressly granted and may keep internal drafts, prompts, notes, working files and production materials.
04Content you provide
You confirm that names, stories, messages, lyrics, images, recordings, references and other material you submit are provided lawfully and with any required rights, permission and consent.
Do not submit unlawful, harmful, abusive, defamatory, privacy-invasive or unauthorised third-party content, including copyrighted lyrics, melodies, recordings, celebrity voice requests or brand material you do not have the right to use.
05Orders we may refuse or edit
We may reject, cancel, refuse or request changes to an order that we reasonably believe is harmful, offensive, abusive, misleading, defamatory, discriminatory, privacy-invasive, unlawful or inconsistent with the purpose of Unsaid Melody.
We may also rewrite, soften, restructure or remove submitted wording to improve grammar, rhythm, musical quality, emotional tone, cultural suitability and legal safety. Final lyrics may therefore differ from the exact wording you submit.
06Third-party creative tools
Unsaid Melody may use third-party creative, production, editing, vocal, sound, hosting and delivery tools. We take reasonable care to use tools and account types that permit the intended use, but cannot guarantee copyright protection, platform approval, monetisation approval or freedom from all third-party claims.
For high-risk commercial uses such as major paid campaigns, broadcast, political content, large commercial releases or substantial client work, an Extended Commercial Licence may be required and independent legal advice should be considered before use.
07Revisions and delivery
Revisions are limited to reasonable changes within the scope of the original order. A revision does not include a completely new song, story direction, receiver, language, genre, vocal style or materially different intended use unless separately agreed.
Delivery times are estimates unless expressly guaranteed. Your song is delivered on a private page with a downloadable audio file. Please download and keep a copy; private page access is available for 30 days after delivery.
We are not responsible for delays caused by incomplete information, unclear instructions, missing approvals, payment issues, third-party platforms, technical issues or events outside our reasonable control.
08Your use after delivery
After delivery, you are responsible for how the song is used, shared, published, uploaded, distributed, performed or monetised, and for checking the rules of any platform, advertiser, publisher, broadcaster, employer, client or other service involved. Use outside the included rights requires our prior permission or an Extended Commercial Licence.
We do not guarantee any emotional, relationship, audience, social media, commercial, promotional, financial, copyright or platform outcome.
09Refunds and cancellations
Because each song is custom-made, refunds are not available once production has started, except where required by applicable consumer law. A cancellation requested before production starts may be refunded at our discretion.
If there is a service problem, contact us within the stated revision or support period so we can assess an appropriate correction, replacement, revision or other remedy. Nothing in these Terms removes rights that cannot legally be excluded.
10Liability and customer responsibility
To the extent permitted by applicable consumer law, Unsaid Melody is not liable for indirect, incidental, consequential, emotional, reputational, commercial, financial, legal or platform-related loss arising from submitted content, the service or use of the final song.
You agree to indemnify Unsaid Melody for claims, loss, damage, cost or liability arising from your submitted content, breach of these Terms, infringement of third-party rights, unlawful or unauthorised use, or use outside the rights granted under these Terms. The indemnity is capped at the amount paid for the relevant song, except for third-party intellectual-property infringement, confidentiality or privacy breaches, unlawful conduct, fraud, intentional misuse or use outside the rights granted.
11Changes to these Terms
Unsaid Melody may update these Terms from time to time. The Terms that apply to an order are the Terms available when that order is placed, unless a change is required by law or by a third-party platform used to provide the service.
